J R Crompton produced paper for decades before being bought out by Glatfelter in 2006. Despite previous cases being settled against this company, the insurers and Glatfelter took a hard stance on settling any more cases. (No allegation has been made that Glatfelter exposed their employees to harmful levels of noise since taking over the firm).
After a long protracted battle which needed expert evidence from ear nose and throat surgeons, engineers and barristers the defendants finally accepted that the noise levels inside the factory were hazardous and injurious to their employees’ hearing prior to a stricter regime of hearing protection being implemented.
This has resulted in the defendants recently accepting an offer to settle the claim which we made so long ago as September 2013. This is a clear example where the insurance industry would have the general public believe that it is the solicitors who are increasing the costs associated with these cases when clearly there could have been a huge saving on costs in this case if the offer we made over 18 months ago was accepted at the time.
Despite this, there are still cases to be settled against J R Crompton and even with the evidence stacked against them, they are seemingly determined to delay any attempts to compensate their former and current employees for hearing loss sustained in the course of their employment which could easily have been prevented with proper training and adequate hearing protection.
Thankfully our client will now receive compensation in the sum of £9,300 and is extremely happy with the outcome.
