Noise induced hearing loss sufferer Mr D, wins settlement of over £3,500.00 through WE Solicitors.

Mr D was exposed to excessive levels of noise, whilst working in noisy environments with several different employers, for a period of over 35 years. He was first exposed when he worked for Van Den Berghs & Jurgens Ltd in Bromborough, Wirral. He was employed as an apprentice joiner and exposed to the noise of the machinery in the building department and the production areas.

Mr D was then exposed with Cammell Laird Shipbuilders Ltd of Birkenhead. He was employed as a joiner and exposed to the noise of power tools and hammering, sometimes in confined spaces, in new build ships.

The claimant was then employed by Cammell Laird Group Plc, also of Birkenhead. He was employed once more as a joiner and worked in a work shop; his role involved the manufacture of cabin furniture for ships. He was exposed to the noise of woodworking machinery and the extraction system.

During Mr D’s employment with these companies, he was never provided with hearing protection and nor was he ever made aware of the dangers that working in excessive noise gives rise to. Mr D now suffers from mild noise induced hearing loss, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. This was presented to the defendants, as part of the evidence, to support Mr D’s claim.

Mr D has a claim ongoing against a final defendant company, also for his resulting hearing condition.

WE Solicitors were able to negotiate an out of court settlement of £3,562.40 for Mr D, which was based on a global valuation of the case, at £4,000.00.
