Noise induced hearing loss sufferer, Kevin Moylett, wins settlement of over £4,000.00, through WE Solicitors.
Mr Moylett was exposed to excessive levels of noise, whilst working in heavy industry for a period of around 14 years. Mr Moylett worked for Redpath Dorman Long Ltd, which later became Appleby Frodingham Steel and then British Steel, during his period of employment. Mr Moylett was employed at the site in Scunthorpe.
Mr Moylett was employed both as an a apprentice plater and a qualified plater throughout this period. His job involved using machinery such as grinders, electric shears, drills, riveters and welders, all of which made for very noisy working processes. Additionally, many of Mr Moylett’s colleagues were using similar machinery in the same working environment, which made the noise levels even louder.
During Mr Moylett’s employment, he was never provided with hearing protection and nor was he ever made aware of the dangers that working in excessive noise gives rise to. Mr Moylett now suffers from mild noise induced hearing loss and mild noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. This was presented to the defendants, as part of the evidence, to support Mr Moylett’s claim.
Some of Mr Moylett’s noise exposure could not be claimed for, as some of his periods of exposure were only a few months at a time and were therefore too short to claim for.
Despite this, WE Solicitors were able to negotiate an out of court settlement of £4,163.40 for Mr Moylett, avoiding the need for court proceedings. Furthermore, Mr Moylett has had a previous successful claim against Normanby Construction Ltd, for noise induced hearing loss, which settled several months ago. Both Mr Moylett and WE Solicitors are very pleased with the outcome.
