Out of Court Settlement Reached

Mrs W, wins settlement of over £1,100.00 through WE Solicitors, in respect of her noise induced hearing loss claim.

Mrs W was exposed to excessive levels of noise, whilst employed by SGH Moulds Ltd of Bolton, Lancashire, for a period of 3 years.

Mrs W was employed as a machine operator throughout and exposed to the noise of injection moulding machinery, for the duration of her shifts. There were approximately 20 injection moulding machines in her department, which varied in size.

During Mrs W’s employment, she was never provided with hearing protection and nor was she ever made aware of the dangers that working in excessive noise gives rise to. Mrs W now suffers from mild to moderate noise induced hearing loss and severe noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of her hearing condition. This was presented to the defendants, as part of the evidence, to support Mrs W’s claim. Mrs W now has to wear a hearing aid, to help with her hearing problems.

Some of Mrs W’s noise exposure cannot not be claimed for, as some took place prior to 1963, which is the date of guilty knowledge. Additionally, some of her periods of exposure were only a few months at a time and were therefore too short to claim for. Mrs W has 3 further ongoing claims against other companies, for excessive exposure to noise and we await those outcomes.

In respect of Mrs W’s claim against SGH Moulds Ltd, WE Solicitors were able to negotiate an out of court settlement of £1,116.00, avoiding the need for court proceedings. Mrs W said “I am very pleased with the outcome of my case” .
