Mr H was exposed to excessive levels of noise, whilst working in the weaving industry for a number of years. Mr H worked for Perseverance Mills Ltd of Albion Mills, Albion Street, Padiham, Burnley. He was employed as a maintenance fitter, a lead fitter and a third engineer, during this time, working within the maintenance department.

Mr H’s role required that he worked in numerous areas of the mill, however, for the first few years of his employment, he spent around 70% or so of his time within the weaving shed, where he was involved in the replacement of looms, as more modern equipment was brought it. Consequently, he was exposed the noise of the looms in operation around him, which produced noise levels of over 90dB.

Unfortunately, hearing protection was not mandatory at the start of Mr H’s employment and was not made so, until later on, by which time, his hearing had been damaged already. Mr H now suffers from mild noise induced hearing loss and mild noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition, with an Ear, Nose and Throat Specialist. This was presented to the defendants, as part of the evidence, to support Mr H’s claim.

WE Solicitors were able to negotiate a settlement of £5,000.00 for Mr H, following service of court proceedings, but pre-trial. Both Mr H and WE Solicitors are very pleased with the outcome.
