Mr J was exposed to excessive levels of noise, whilst working in the engineering industry for a period of around 4 years from 2001 to 2005. Mr J worked for Triplex Components Machining Ltd, during his period of employment (also known as Peak Engineering). The company was based on Mason’s Road, Stratford upon Avon, Warwickshire. He was employed as a machinist throughout and exposed to the noise of the 25 ton rotary milling machine, which he operated and other milling machines within his working environment.
Mr J was not provided with hearing protection until late on into his employment, however, its use was not enforced and he advises it would in fact, often run out. He estimates that he wore hearing protection for around 30% of the time after it was introduced. Mr J advises he was never made aware of the dangers that working in excessive noise gives rise to, by way of any noise awareness training or instructions.
Mr J now suffers from mild noise induced hearing loss and moderate noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. This was presented to the defendants, as part of the evidence, to support Mr J’s claim.
