Noise Induced Hearing Loss Sufferer, Mrs H, Wins Settlement of £5,000.

Mrs H was exposed to excessive levels of noise, whilst working in the Textile industry for a period of over 40 years. Mrs H’s claim was pursued against:

–      Lancashire Cotton Corporation Limited, where she was exposed to excessive noise from spinning, doffing and ring frame machines. Mrs H worked at the mills in Failsworth known as Mersey Mill and Regent Mill.

–      Cotton & Rayon Spinners Limited, Mrs H worked at the Rugby Mill in Chadderton and was exposed to excessive noise from spinning machines.

–      Mather & Platt Limited based at their Park Works Site, she was exposed to excessive noise from the presses and goss machines.

During Mrs H’s employment, she was never provided with hearing protection and nor was she ever made aware of the dangers that working in excessive noise gives rise to. Mrs H now suffers from mild noise induced hearing loss and mild noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of her hearing condition. This was presented to the defendants, as part of the evidence, to support Mrs H’s claim.

Some of Mrs H’s noise exposure could not be claimed for, as some took place prior to 1963, which is the date of guilty knowledge. Additionally, the insurers were unidentified for some periods of her employment.

Despite this, WE Solicitors were able to negotiate an out of court settlement of £5,000 for Mrs H, avoiding the need for court proceedings.
