Mr Walsh was exposed to excessive levels of noise, whilst working in the engineering industry for a period of around 2 years. Mr Walsh worked for Richard White & Sons (Engineers) Ltd, of Ditton Road, Widnes, Cheshire. He was employed as a machinist throughout and exposed to the noise of the blacksmith’s forge, planer machinery, cutting machinery, milling machinery, bending machinery, steam hammers, radial arm drills, to name but a few.
During Mr Walsh’s employment, he was never provided with hearing protection and nor was he ever made aware of the dangers that working in excessive noise gives rise to. Mr Walsh now suffers from mild noise induced hearing loss and moderate noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. This was presented to the defendants, as part of the evidence, to support Mr Walsh’s claim.
The case was not without issue, as Mr Walsh had been exposed to noise with other defendants, but the company was dissolved and the insurance history was no longer available. Therefore, some of Mr Walsh’s noise exposure could not be claimed for.
Despite this, WE Solicitors were able to negotiate an out of court settlement for Mr Walsh, avoiding the need for court proceedings. Both Mr Walsh and WE Solicitors are pleased with the outcome.
