Mr Maurice Barson has been successful in his claim for noise induced hearing loss against:
– Sheepbridge Engineering Limited
– Tetherworth Engineering (Sheepbridge) Limited and;
– Metry Engineerig Limited
Mr Barson was exposed to excessive noise from machinery used to make machnies for the mining industry.
During Mr Maurice Barson’s employment, he was never provided with hearing protection and nor was he ever made aware of the dangers that working in excessive noise gives rise to. Mr Maurice Barson now suffers from mild noise induced hearing loss and mild noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of her hearing condition. This was presented to the defendants, as part of the evidence, to support Mr Maurice Barson’s claim.
Some of Mr Maurice Barson’s noise exposure could not be claimed for, as some took place prior to 1963, which is the date of guilty knowledge. Additionally, some of her periods of exposure were only a few months at a time and were therefore too short to claim for.
Despite this, WE Solicitors were able to negotiate an out of court for Mr Maurice Barson, avoiding the need for court proceedings. Both Mr Maurice Barson and WE Solicitors are very pleased with the outcome.
