Mr Turner was exposed to excessive levels of noise, whilst working in the engineering industry for a period of over 20 years. Mr Turner worked for Appleby Slag Co Ltd, which was also known as The Appleby Group and Civil & Marine, during his period of employment. The company was based at Brigge Road, in Scunthorpe.

Mr Turner was employed as a joiner fitter in the maintenance department and briefly as a digger driver. His job took to him many parts of the factory and during this time, he was exposed for example, to the noise of the grinding mills and the glass plant, amongst other sources of noise.

During Mr Turner’s employment, hearing protection was unavailable until around 1994 and not enforced until around 3 years before he left the company. Mr Turner now suffers from mild noise induced hearing loss, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. This was presented to the defendants, as part of the evidence, to support Mr Turner’s claim.

The case was not straightforward, as the company is no longer operating as it was at the time of Mr Turner’s employment. Following the commencement of court proceedings, an acoustic engineer’s report was obtained which confirmed that on the basis of the evidence available, Mr Turner would have been exposed to excessive levels of noise, during his employment with the defendant.

WE Solicitors were able to negotiate a settlement of £3,000.00 for Mr Turner, avoiding the need for the case to go to trial. Both Mr Turner and WE Solicitors are very pleased with the outcome.
