Mrs O wins £3,500

Mrs O, wins settlement of £3,500.00 through WE Solicitors, for noise induced hearing loss and associated tinnitus.

Mrs O was exposed to excessive levels of noise, whilst working in the weaving industry for a period of over 10 years, with no hearing protection until late on in her employment. Mrs O worked for Smith & Nephew Medical Fabrics Ltd, formerly Smith & Nephew Textiles Ltd of Brierfield Mills, Brierfield, Lancashire. She was employed as a spinner throughout in the Spinning Department (or warps) of the mill and exposed to the noise of many spinning frames, during the course of her working day.

During Mrs O’s employment, which consisted of a few months during 1970/71 and then from 1973 to 1993, she was not provided with hearing protection, nor made aware of the dangers that working in excessive noise gives rise to, until the damage had already been done.

Mrs O now suffers from mild noise induced hearing loss and mild noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of her hearing condition. This was presented to the defendants, as part of the evidence, to support Mrs O’s claim.

WE Solicitors were able to negotiate an out of court settlement of £3,500.00 for Mrs O, avoiding the need for court proceedings. Both Mrs O and WE Solicitors are very pleased with the outcome.
