Mrs Jones was exposed to excessive levels of noise, whilst working for Rotile Ltd, which was a small company, manufacturing roof tiles. Mrs Jones was employed at the site at Monastery Road Business Centre, West Glamorgan, between the years 1992 to 1994. She was employed as a machine operator throughout this period and exposed to the noise of machinery used for pressing out the tiles and machinery for mixing the tile material.
During Mrs Jones’ employment, she was never provided with hearing protection and nor was she ever made aware of the risk that working in excessive noise poses. Mrs Jones now suffers from mild noise induced hearing loss and moderate noise related tinnitus, which was confirmed following a medical assessment of Mrs Jones’ hearing condition, arranged by WE Solicitors. This was presented to the defendant’s representatives, as part of the evidence, to support Mrs Jones’ claim.
Some of Mrs Jones’ noise exposure could not be claimed for, as some took place prior to 1963, which is the date of guilty knowledge.
Despite this, WE Solicitors were able to negotiate an out of court settlement of just £1,292.50 for Mrs Jones, in respect of her claim against Swan Mill Holdings Ltd. Mrs Jones has also had a previous successful claim for her hearing condition against the company Tower Housewares Ltd (Midland Metal Spinning Ltd), for which she was awarded just over £2,786.45. Her final claim against Rotile Ltd settled for £292.50, as she was only exposed for a short time there.
