Mr Butler Awarded Compensation of Just Over £4,300.

 
 
 
Mr Butler was exposed to excessive levels of noise, whilst working in the weaving industry for a period of around 7 and a half years, during the years 1968 to 1975. Mr Butler worked for Smith & Nephew Textiles Ltd, of Brierfield Mills, Brierfield, Lancashire. He was employed as a tape bander and a spinning doffing mechanic, throughout this time and exposed to the noise of the spinning machines, in the spinning department. Mr Butler advises that it was so noisy, he would have to shout right into his colleague’s ear, if he wanted to communicate in the spinning department.

During Mr Butler’s employment, he was never provided with hearing protection and nor was he ever made aware of the dangers that working in excessive noise gives rise to. Mr Butler now suffers from a moderate degree of noise induced hearing loss and also moderate noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. The tinnitus can sometimes be such that it stops Mr Butler from getting to sleep at night. The medical evidence was presented to the defendants, as part of the evidence, to support Mr Butler’s claim.

WE Solicitors were able to negotiate an out of court settlement of £4,343.60 for Mr Butler, avoiding the need for court proceedings. Both Mr Butler and WE Solicitors are pleased with the outcome.
