Machine Operator at Perry Chain Co Ltd wins over £2500 payout

 
 
 

Mrs D wins over £2500 payout after working as a Machine Operator at Perry Chain Co Ltd from 196162 – 1964/6, 1982/83 and Apex Packaging Co (Swansea) Ltd from 1987/88 to 1988/89 caused her to lose some of her hearing.

This was a particularly difficult case as it was necessary to identify which companies to sue because the payment of your compensation will be divided between them.

If the company is only responsible for a small part of the exposure (less than 10%) we do not usually recommend suing them.  There are two reasons for this, firstly a legal rule called ‘de minimus’ which means the injury is to small to be worth suing for.  Secondly the legal costs of pursing a claim worth less than £1,000 cannot be claimed.  Unfortunately Mrs D lost 3.7% of her compensation due to this but we solicitors were able to negotiate a settlement Mrs D was happy with without her needing to issue court proceedings.
