Former Metal Worker from Prescot is Awarded £4750 for Noise Induced Hearing Loss

Mr P was exposed to excessive levels of noise, whilst working for a company called Applied Fusion based in Prescot Lancashire and was employed a metal fabricator. The company made ships vessels and large metal structures both in the workshop in Prescot and on site. He was employed as a Welder and fabricator in the factory. The claimant worked in confined spaces welding metal plates together and he was often exposed to excessive levels of noise throughout his apprenticeship and subsequent employment.

During Mr P’s employment, he was never provided with hearing protection and nor was he ever made aware of the dangers of working in excessive noise. Mr P now suffers from noise induced hearing loss and mild noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. This was presented to the defendants, as part of the evidence, to support the claim.

It is unfortunate that many people are still suffering decades on from the legacy of our industrial past and relaxed health and safety policies. Mr P’s hearing would not have been damaged had him employers simply provided hearing protection.

WE Solicitors were able to negotiate an out of court settlement of £4,750 avoiding the need for court proceedings.
