Mr Hall was exposed to excessive levels of noise, whilst working in the carpet weaving industry for a period of 5 years. Mr Hall worked for Tunstead Needlefelt Co Ltd of Haslingden, Lancashire. He was employed as a latex machine operator throughout and exposed to the noise of latex machines, air conditioning systems, compressed air machines, drills and machinery which was used for needling the carpet felt.

During Mr Hall’s employment, he was never provided with hearing protection and nor was he ever made aware of the dangers that working in excessive noise gives rise to. Mr Hall now suffers from mild noise induced hearing loss and mild noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. This was presented to the defendants, as part of the evidence, to support Mr Hall’s claim.

Some of Mr Hall’s noise exposure could not be claimed for, as some of the other companies where he was exposed to noise are no longer trading and their former insurers could not be traced. Additionally, his exposure for around 6 months with another company was too short to claim for.

Despite this, WE Solicitors were able to negotiate an out of court settlement for Mr Hall, which was made on the basis of a global valuation of £3,000.00. After discounts in relation to the periods which could not be claimed for, Mr Hall received £1,379.70. The claim settled without the need for court proceedings.
