Mr I was exposed to excessive levels of noise, whilst working for Lamp Caps Ltd of Sheffield Road, Chesterfield, Derbyshire from 1977 to 1994. Mr I was employed as an apprentice fitter, a maintenance fitter and a shift supervisor, during this time. He moved around within the factory and worked in the training workshop, the Shell Press department, the Pinners department, the Vitrite department, the Dipping department and the mixing room.
During Mr I’s time at Lamp Caps, he was exposed to the noise of numerous different kinds of machinery, including compressed air powered tools, presses, pinner machines, furnaces and other machines, all involved in the manufacture of caps for lights and lamps.
Mr I advises that hearing protection was not made compulsory until around 1991, but which time, much damage had already been done to his hearing. Mr I now suffers from mild noise induced hearing loss, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. This was presented to the defendants, as part of the evidence, to support Mr I’s claim.
Some of Mr I’s noise exposure could not be claimed for, as some of the insurance history of the company could not be traced.
Despite this, WE Solicitors were able to negotiate an out of court settlement of £4,386.07 for Mr I, avoiding the need for court proceedings. Both Mr I and WE Solicitors are very pleased with the outcome.
