Mr W worked at the Metal Box Co Ltd site based in West Houghton, Bolton. The company is now known as Crown Packaging UK Plc.
Mr W was employed as a Maintenance Plumber. Amongst others, he was exposed to excessive levels of noise from can making machines (also known as body making machines), presses, printing machines and compressors, whilst working in the industry for a period of around 18 years.
Mr W’s son saw an advert in the local paper which specifically mentioned working at Metal Box Co Ltd. Mr W put his hearing problems down to age and had his son not seen the advert, it is unlikely that he would have been aware that he could be entitled to compensation.
Mr W now suffers from mild noise induced hearing loss and mild noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. This was presented to the defendants, as part of the evidence, to support Mr W’s claim.
Despite this, WE Solicitors were able to negotiate an out of court settlement of £5,500 for Mr W, avoiding the need for court proceedings. Both Mr W and WE Solicitors are very pleased with the outcome and Mr W said ‘there was no pressure from anyone for my claim which is a very good thing’.
