Mr Cheeseman wins £4000 payout after working from 1959-1981 starting as a Junior Labourer and working his way up to Mill Controller at Appleby Frodingham (now Corus) in Scunthorpe.  He was exposed to excessive noise and this caused him to lose some of his hearing.

This was a particularly difficult case as some of Mr Cheeseman’s employment was before 1963, which is the date that has been found to be when employers should have protected their employees from damaging noise levels over 85db. This is due to the publication of a document called ‘Noise and the Worker’ by the Ministry of Labour.  This had the effect of reducing the amount of compensation Mr Cheeseman would receive, however in previous cases and in certain circumstances the court has ruled that a company  has special knowledge so should have taken steps to protect their employees earlier.

In Mr Cheeseman’s case we raised this and argued that Appleby Frodingham falls in this category.  The representatives of the company did not agree with our argument but were willing in the circumstances to increase their offer of settlement to an amount we thought was sufficient to compensate Mr Cheeseman for his injuries.
