Fomer Mather & Platt Employee Receives Compensation of Over £2,600 for Noise Induced Hearing Loss

 
 
 

Mr G was exposed to excessive levels of noise, whilst working in the foundry industry for a period of over 3 to 4 years. Mr G worked for Mather & Platt Ltd of St Germain Street, Farnworth, in Bolton, between the years; 1978 and 1982. He was employed as a machine moulder, a furnace man and a crane driver, during his employment and was exposed to the noise of moulding machinery, the noise of castings being knocked out, the roar of the furnaces and general factory noise.

During Mr G’s employment, he was never provided with hearing protection and nor was he ever made aware of the dangers that working in excessive noise gives rise to. Mr G now suffers from mild noise induced hearing loss, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. This was presented to the defendants, as part of the evidence, to support Mr G’s claim.

The case was not without issue as there was some difficulty on the defendant’s side, relating to identification of the correct insurers, who would have held cover during the claimant’s period of employment. Furthermore, given the passage of time, the defendant no longer had any relevant documentation, such as noise surveys, to assist with their liability investigations.

Despite this, WE Solicitors were able to negotiate an out of court settlement of £2,625.00 for Mr G, avoiding the need for court proceedings and the risks of litigation. Both Mr G and WE Solicitors are pleased with the outcome.
