Ex Osram Employee Wins Hearing Loss Claim

Mr T of Royton, Oldham was awarded £4,500 compensation for noise induced hearing loss. Mr T was employed by Osram Ltd. of Refuge Street, Shaw where he worked as a Production Operative for approximately three years from approximately 1995 to 1998.

Whilst employed at Osram, Mr T was subjected to excessive noise by the various machinery, which made the environment so noisy that it was impossible to hold a conversation with colleagues, even by shouting. Mr T was never provided with hearing protection by his employers.

Supportive medical evidence was obtained from an Ear, Nose & Throat Consultant who confirmed that Mr T was suffering with hearing loss and tinnitus as a result of exposure to excessive noise.

This was a difficult case as Mr T had consulted his GP in August 2007 regarding his tinnitus and he therefore had 3 years from this date to bring a claim. Mr T did not take steps to pursue a claim for compensation until June 2010 and therefore there was limited time to bring the claim and court proceedings had to be issued to protect Mr T’s position. WE managed to obtain Mr T compensation even when working within the short timescales.
