Mr Keith Jackson was exposed to excessive levels of noise for a period of over 15 years whilst working for Gabescope Ltd as a sheet metal worker, Thomas Withers Security Ltd as a lock and safe maker, M&S Erection as a sheet metal worker and Servis Domestic Appliances as a Rectifier.
He was exposed to excessive noise from air guns, drills, conveyor belts, grinders, hammers, guillotines, milling machines, lathes, captsons, power presses, hand presses and drilling machines for the duration of his shifts.
During his employment Mr Jackson was never provided with hearing protection and nor was he ever made aware of the dangers that working in excessive noise gives rise to.
Mr Jackson now suffers from mild noise induced hearing loss and mild noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. This was presented to the defendants, as part of the evidence, to support the claim.
Some of Mr Jackson’s periods of employment only involved exposure for just a few months at a time and were therefore too short to claim for.
Despite this, WE Solicitors were able to negotiate an out of court settlement in relation to the remainder of Mr Jackson’s employment in the sum of £2860 for avoiding the need for court proceedings. Both Mr Jackson and WE Solicitors are happy with the outcome of the claim.
