Mrs M received undisclosed sum on behalf of her husband who suffered noise induced hearing loss as a result of exposure to excessive noise at work.

Mr M was exposed to excessive levels of noise, whilst working in the paper making industry for a period of over 30 years. Mr M worked for J.R. Crompton Limited during his period of employment. He was employed in various capacities and exposed to the noise of paper making machines, beaters, refiners, digesters and other machinery associated with the paper making industry for long periods of his day.

During Mr M’s employment, he was never provided with hearing protection and nor was he ever made aware of the dangers that working in excessive noise gives rise to. Mr M’s mild noise induced hearing loss and mild noise related tinnitus was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. This was presented to the defendants, as part of the evidence, to support the claim.

Some of Mr M’s noise exposure could not be claimed for, as some took place prior to 1963, which is the date of guilty knowledge. Additionally, some periods of exposure were too short to claim for and there were also a number of periods of missing insurance history.

Despite this, WE Solicitors were able to negotiate an out of court settlement for Mrs M on behalf of her late husband, avoiding the need for court proceedings.
