Settlement of £4,500.00 for Noise Induced Hearing Loss

Our client was exposed to excessive levels of noise, whilst working in the weaving industry from 1970 to 1978 and again from 1981 to 1991. Our client’s claim was against Smith & Nephew Plc, of Brierfield Mills, Brierfield, Lancashire. During the course of his employment, he was variously employed as a spinner, a doffer and latterly, a foreman.

His employment meant that he was exposed to the incredible levels of noise produced by the numerous spinning frames in the spinning departments, or ‘Warps,’ as they were known.

He was not provided with hearing protection until later on and he  advises that the use of hearing protection was not strictly enforced and no training was provided on how to correctly wear the hearing protection. Our client now suffers from mild noise induced hearing loss and mild noise related tinnitus, which was confirmed when WE Solicitors arranged a medical assessment of his hearing condition. This was presented to the defendants, as part of the evidence, to support his claim.

WE Solicitors were able to negotiate an out of court settlement of £4,500.00 in this case, avoiding the need for court proceedings. Both our client and WE Solicitors are very pleased with the outcome.
