Mrs J, a noise induced hearing loss sufferer, wins settlement of just over £2,700.00 through WE Solicitors.
Mrs J was exposed to excessive levels of noise, whilst working for a housewares manufacturer, for a period of just over 10 years. Mrs J was employed by Midland Metal Spinning Co Ltd, which later became Tower Housewares Ltd of Midlands Road, Neath. She was employed as a machine operator throughout this period and exposed to the noise of production line machinery, for the duration of her shifts.
During Mrs J’s employment, she was never provided with hearing protection and nor was she ever made aware of the risk that working in excessive noise poses. Mrs J now suffers from mild noise induced hearing loss and moderate noise related tinnitus, which was confirmed following a medical assessment of Mrs J’s hearing condition, arranged by WE Solicitors. This was presented to the defendant’s representatives, as part of the evidence, to support Mrs J’s claim.
Some of Mrs J’s noise exposure could not be claimed for, as some took place prior to 1963, which is the date of guilty knowledge. Additionally, as the company is dissolved, there are limited records relating to the company’s insurance history and some of the insurers on risk during Mrs J’ employment could not be traced. A discount had to be accepted for these reasons.
Despite this, WE Solicitors were able to negotiate an out of court settlement of just over £2,700.00 for Mrs J who still has two ongoing claims against a further two companies, who also exposed her to excessive levels of noise.
