Mr Rhodes wins a total of £2,000.00 for his noise induced hearing loss claim.
Mr Rhodes had noticed a gradual deterioration in his hearing over approximately the last 10 years after working for several employers, in very noisy environments. He now wears hearing aids, because of his condition.
Amongst the companies where noise exposure occurred were AJ Riley & Son Ltd, Clayton Son & Co Ltd, James Austin & Sons (Dewsbury) Ltd, Halton Pigs Ltd and Minting Metal Finishings Ltd.
Mr Rhodes was not provided with any hearing protection by any of these companies and nor was he warned of the dangers of noise exposure, despite the fact that his work involved metal working, using noisy grinders, exposure to the noise of presses, lathes and in the case against Halton Pigs Ltd, simply the general noise of the pigs.
The case was not without problem as some of the companies have since dissolved and their insurance history was difficult to trace. Therefore, some companies could not be pursued. A medical assessment of Mr Rhodes’ hearing condition confirmed a diagnosis of mild to moderate noise induced hearing loss and moderate tinnitus.
WE Solicitors managed to negotiate the settlement without the case going to trial. Both Mr Rhodes and WE Solicitors are very happy with the outcome.
